Building Regulations and the compliance certificate

Since October 2010 it has been a legal requirement in England and Wales that when 25% or more of a roof is replaced, the work must comply with Building Regulations and be certified accordingly. Roofing work completed by rogue contractors may affect the fire safety of your property and could invalidate expensive home insurance policies. The document that confirms compliance is called a Building Regulations Compliance Certificate – or BRCC. Without a valid BRCC you may encounter problems when it comes to selling your property.

There are two ways to obtain a BRCC. You can go through your local authority Building Control directly, which involves submitting the work for inspection and approval. Or you can use a contractor registered on a Competent Person Scheme – such as the NFRC Competent Person Scheme – who can self-certify the work and issue the certificate directly. Using a contractor with recognition via the NFRC CPS scheme means that once the work has been completed and signed off, the homeowner will receive a BRCC plus a 10-year Insurance Backed Guarantee.

An unaccredited contractor cannot self-certify. If they don’t notify Building Control either — which many don’t – the work is uncertified, the BRCC doesn’t exist, and the legal and financial consequences fall on the homeowner, not the roofer.

Property resale

If you do not have a BRCC and have re-roofed your property, you may not be able to refinance or insure it without evidence that you have complied with Building Regulations. Solicitors routinely request compliance certificates during conveyancing. A missing BRCC can delay or derail a property sale, reduce the value a buyer is willing to pay, or require expensive retrospective certification – which involves Building Control inspecting completed work, potentially requiring areas to be opened up, and charging a higher fee than if the work had been notified in advance.

The German comparison

It is worth noting that in Germany this problem largely doesn’t exist. Under Germany’s ‘Handwerksordnung’ – the national Crafts and Trades Code – roofing is classified as a licensed trade requiring a completed master tradesperson examination before anyone can operate as a roofing contractor. An unqualified person simply cannot legally set up as a roofer. Professional trade and craft groups in Germany have noted that removing such qualification requirements led to poorer quality work, a lack of trained apprentices and failing businesses – observations that resonate in the UK context where no such mandatory licensing exists.

What this means in practice

ACSAP is registered on the NFRC Competent Person Scheme, which means we can self-certify re-roofing work and issue a Building Regulations Compliance Certificate directly upon completion, along with a 10-year Insurance Backed Guarantee. You do not need to separately notify Building Control or arrange an inspection.
